Applies to: Agreement V1.0/V2.0 (legacy)
"Legacy" marks anything written for Agreement Versions 1.0 or 2.0 or for the retired Joinder and Online Reliance Systems — that is, before March 17, 2025. SMART IRB keeps these materials because institutions with arrangements documented under those versions may still need them for the life of those studies.
When to use them. Only for studies and arrangements documented under V1.0/V2.0 before the transition. For anything new, use the Version 3.0 resources.
Can I keep using an older template under V3.0? SMART IRB recommends updating to the V3.0 versions, which reflect the new terms (HIPAA responsibilities, insurance, indemnification, Mandated Policies). An older template may be used only if the way you use it is consistent with Version 3.0 — for example, a legacy LOA that assigns HIPAA determinations to the Reviewing IRB would need to be treated as a documented flexible implementation, not the default.
